Preparing for a FOIA Denial or Partial Release

When a federal agency withholds records, read the notice carefully before drafting a response. This is a preparation guide, not legal advice.

Read the stated exemptions

Look for the statutory exemption citations, which records were searched and whether the agency gave appeal instructions.

Separate the problems

Was the search scope too narrow, were records missing, or was the exemption explanation unclear? Different objections call for different follow-up questions.

Preserve deadlines

Use the specific agency letter and current official appeal guidance for the deadline, address and submission method. Do not assume every agency uses the same process.

Keep requests factual

Quote the record description and the relevant portions of the denial. Ask for clarification about segregable non-exempt information when appropriate.

Save the full trail

Keep copies of original submissions, email receipts, appeals and any revised agency response.

Keep a record of what you verify

Save the source, date checked, exact service or product name, and any written confirmation that changes how you should act. Use official documents for rules and a qualified professional for individualized advice.
